Trump’s Pick To Lead DEA Says Marijuana Rescheduling Review Will Be ‘One Of My First Priorities’ In The Job

“We know where we are,” Padilla told the nominee. “We know what the directive is: Get it to Schedule III,” he said, referring to a rescheduling recommendation from the Department of Health and Human Services.

“Are you committed to seeing it to fruition?” the senator asked.

“I don’t know. I haven’t seen it,” Cole said.

“So you’re leaving the door open to changing course,” the senator said.

“I’m leaving the door open to studying everything that’s been done so far, so I can make a determination,” the prospective DEA head said.

Cole also said in response to questions from Sen. Thom Tillis (R-NC) at the hearing that he feels it’s appropriate to form a “working group” to look at the federal-state marijuana law disconnect in order to “stay ahead of it.”

Tillis raised concerns he had about the fact that an Indian tribe has legalized marijuana for adult use on their territory within North Carolina, which has not yet enacted legalization at the state level.

“The whole patchwork of state laws around legal marijuana, medical marijuana, it’s very confusing. I think it’s out of control,” the senator said. “And, ultimately, I believe the United States, the federal government, needs to set boundaries.”

“It’s pretty clear to me that most states are going to legalize it at some level—so this is not intended to be a message about the future of marijuana, but it’s about the present of marijuana,” he said before asking the nominee if he would commit “to look through the mechanics of this operation and give me a definitive answers to questions” he raised with the prior administration last year.

“Yes, sir, you have my commitment, Cole said, adding that he’d want to first consult with the U.S. attorney in the region as well as DEA counsel to provide an adequate response.

“Does it make sense, at some point for law enforcement purposes, that we should come up with the rules of the road so there’s consistent application [of marijuana laws] across the 50 states?” Tillis asked.

“I think this is definitely worthy of a working group, because, to your earlier points, we need to stay ahead of it,” Cole said.

The lines of questioning didn’t produce a definitive answer as to the question of where Cole ultimately stands on marijuana policy or how he’d treat the rescheduling process if confirmed. But it does signal he’s given the issue some amount of thought as he potentially enters into the critical role of DEA administrator.

“No matter what you think of Senator Tom Tillis‘s questions or comments, anytime the issue of cannabis is brought up in the Senate Judiciary Committee, we are winning,” Don Murphy, co-founder of American Cannabis Collective, told Marijuana Moment. “We are making incremental steps that will lead to an end to prohibition sooner rather than later.”

Cole has previously voiced concerns about the dangers of marijuana and linked its use to higher suicide risk among youth.

The nominee worked at DEA for 21 years and currently serves as Virginia’s secretary of Public Safety and Homeland Security (PSHS), where part of his responsibility is to oversee the state Cannabis Control Authority (CCA).

After a visit to CCA’s office last year, Cole posted on LinkedIn: “Everybody knows my stance on marijuana after 30 plus years in law enforcement, so don’t even ask!”

Trump initially chose Hillsborough County, Florida Sheriff Chad Chronister to lead DEA, but the prospective nominee—who strongly advocated for marijuana decriminalization—withdrew from consideration in January amid scrutiny from conservative lawmakers over the sheriff’s record on COVID-related public safety enforcement actions.

As far as the marijuana rescheduling process is concerned, DEA recently notified an agency judge that the proceedings are still on hold—with no future actions currently scheduled as the matter sits before the acting administrator, Derek Maltz, who has called cannabis a “gateway drug” and linked its use to psychosis.

Meanwhile, although shutting down licensed marijuana dispensaries doesn’t “rise to the top” of his priorities, a U.S. attorney who recently warned a Washington, D.C. cannabis shop about potential federal law violations says his “instinct is that it shouldn’t be in the community.”

Separately, last week, an activist who received a pardon for a marijuana-related conviction during Trump’s first term paid a visit to the White House, discussing future clemency options with the recently appointed “pardon czar.”

A marijuana industry-backed political action committee (PAC) has also released a series of ads over recent weeks that have attacked Biden’s cannabis policy record as well as the nation of Canada, promoting sometimes misleading claims about the last administration while making the case that Trump can deliver on reform.

Its latest ad accused former President Joe Biden and his DEA of waging a “deep state war” against medical cannabis patients—but without mentioning that the former president himself initiated the rescheduling process that marijuana companies want to see completed under Trump.

Terrance Cole, President Donald Trump’s nominee to lead the Drug Enforcement Administration, said it will be one of his “first priorities” to check on the marijuana rescheduling process if he’s confirmed—but he refused to commit to moving cannabis to Schedule III as federal health officials have recommended.

  • Cole also said he wants to form a marijuana “working group” in response to a senator’s questions about the growing federal-state divide on cannabis laws.

The Small Business Administration published updated guidance clarifying that marijuana businesses are not eligible for key federal loan programs “even if the business is legal under local or state law where the Applicant is or will be located.”

Veterans Affairs Secretary Doug Collins reiterated his support for exploring psychedelic therapy options for military veterans, saying his department is “committed to doing what we can to make the veteran’s care better.”

Bipartisan House and Senate lawmakers filed legislation to automatically seal records for certain non-violent federal marijuana offenses and to provide assistance for expunging convictions at the state level.

The Texas House Public Health Committee amended and approved two bills aimed at speeding up access to psychedelic therapy following federal approval of substances like psilocybin and MDMA.

Kentucky Auditor Allison Ball (R) is accusing the Kentucky Democratic Party of using “intimidation tactics” by filing public records requests about her investigation into the Office of Medical Cannabis’s business licensing process.

/ FEDERAL

The U.S. Court of Appeals for the First Circuit ruled that the odor and sight of marijuana gave a police officer reasonable suspicion to prolong a traffic stop that resulted in the seizure of an illegal firearm.

Sen. Bernie Moreno (R-OH) will reportedly be the lead Republican sponsor of a cannabis banking bill this session.

Rep. Ilhan Omar (D-MN) said the Congressional Cannabis Caucus still hasn’t met this year.

Nebraska’s attorney general discussed his opposition to medical cannabis. Separately, a senator said he believes lawmakers have reached a compromise on medical marijuana implementation legislation.

The Ohio Senate passed a bill to restrict the sale of intoxicating hemp products to marijuana dispensaries.

The Minnesota House of Representatives passed a bill providing funding for cannabis regulators.

A Florida representative said hemp regulation legislation is dead for the session.

Missouri regulators announced a recall of marijuana products whose design resembles non-marijuana non-marijuana products.

Maryland regulators published guidance on marijuana processing and growing.

Illinois lawmakers launched a new medical cannabis registration portal.

Oregon regulators will host listening sessions about the psilocybin services program in June.

How to Make Cannabis Inventory Decisions That Drive Profit

Managing cash flow while optimizing inventory is no easy task in an industry marked by tight margins and regulatory hurdles. Dispensaries and vertically integrated operators alike are caught between financial constraints and the need for efficient systems, processes, and people to drive profitability.

Flipping the Mindset: From Seed-to-Sale to Sale-to-Seed
Traditionally, the cannabis industry has operated on a “seed-to-sale” model, focusing on tracking product from cultivation to final sale. This model ensures compliance with regulatory requirements and helps maintain product quality and safety. However, flipping this mindset to a “sale-to-seed” strategy could be the key to unlocking sustainable growth and profitability. By putting data-driven procurement at the forefront, operators can make smarter inventory decisions that protect margins and improve cash flow.

Leveraging Point-of-Sale Analytics
One of the critical steps in adopting a sale-to-seed approach is leveraging Point-of-Sale (POS) analytics to understand purchasing patterns and margins. By analyzing sales data, dispensaries can identify which products are not only best-selling but also those driving the largest margins. This information is crucial for making informed decisions about what to stock and in what quantities. For example, if a particular cannabis strain is consistently selling out, it may be worth increasing the order quantity or even considering cultivating it in-house if the margins can support that approach. It can also assist with vendor coordination, discounting management and menu components.

Analysis of a particular product type may be revealing. For example, compare sales, traction rate, and margin for 3.5g hybrid small-bud flower.  It may be surprising that, although one brand may have higher sell-through, the margins may be lower than another product in the same category. Action items could be to negotiate a better cost with the vendor, test various pricing changes, and/or promote the higher-margin product more extensively.

For high-volume, low-margin products, there may be specific circumstances that led to the higher sales and/or lower margins. Before making any decisions about purchasing volume, identify possible reasons. Was there a specific promotion?  Bundle? Sometimes, products on promotion from vendors might sell quickly but offer lower margins. POS analytics can help dispensaries identify if these promotions are truly beneficial. Did it lead to buyer loyalty, even when pricing is returned to market value?

POS analytics tools can provide insights into customer preferences, peak purchasing times, and seasonal trends. By understanding these patterns, businesses can optimize their inventory levels, reduce stockouts, and minimize excess inventory. Additionally, POS analytics can help identify slow-moving products that may need to be discounted or removed from the inventory altogether. 

Forecasting Demand Based on Market Trends and Consumer Behavior
Another essential component of the sale-to-seed strategy is forecasting demand based on market trends, historical sales data and consumer behavior. This involves looking at broader industry trends, such as the increasing popularity of certain product types (e.g., edibles, infused prerolls) and seasonal variations in demand. For example, if data shows a spike in demand for edibles during the holiday season, businesses can plan their inventory accordingly to meet this demand.

By understanding these trends, operators can better anticipate which products will be in high demand and adjust their inventory accordingly. This proactive approach helps prevent stockouts and overstock situations, both of which can negatively impact cash flow.

Evaluating Make-or-Buy Decisions
Evaluating make-or-buy decisions is another critical step in the sale-to-seed strategy for vertically integrated businesses. This involves determining whether it is more cost-effective to produce a product in-house or to purchase it from a third-party supplier. For example, if a dispensary finds that it can buy a particular product from a vendor at a lower cost than it would take to produce it in-house, it may make sense to outsource that product. Conversely, if the margins are better for in-house production, the dispensary may choose to invest in the necessary equipment and resources to produce the product themselves.

Make-or-buy decisions should be based on a thorough analysis of costs, quality, and capacity. Businesses need to consider factors such as production costs, lead times, and the availability of raw materials. Additionally, they should evaluate the potential risks associated with outsourcing, such as supply chain disruptions and quality control issues.

Implementing Just-in-Time Inventory Practices
Implementing just-in-time (JIT) inventory practices is another way to optimize inventory and improve cash flow. JIT inventory management involves ordering and receiving inventory only as it is needed, rather than keeping large quantities of stock on hand. This approach helps minimize carrying costs and reduces the risk of product expiration, which is particularly important given the limited shelf life of cannabis product. By keeping inventory levels lean, dispensaries can free up cash that would otherwise be tied up in excess stock.

JIT inventory practices require close coordination with suppliers and vendors and a robust inventory management system. Businesses need to have real-time visibility into their inventory levels and demand forecasts to ensure they can meet customer needs without overstocking. Additionally, they should establish strong relationships with reliable suppliers and vendors who can deliver products quickly and consistently.

Technology and Tools for Inventory Management
The cannabis industry has access to a wide range of technologies and tools that can help optimize inventory management and cash flow. Inventory management software, POS systems, and advanced analytics tools are just a few examples. These technologies can provide real-time insights into inventory levels, sales trends, and customer preferences, enabling businesses to make data-driven decisions.

For example, inventory management software can automate the tracking of stock levels, generate reorder alerts, and provide detailed reports on inventory performance. POS systems can capture sales data and, through various tools or dashboards, can integrate with inventory management software to provide a comprehensive view of the business. Advanced analytics tools can analyze this data to identify trends, forecast demand, and optimize inventory levels.

Sale-to-Seed Is Gaining Traction
While perhaps not yet formally dubbed “sale-to-seed,” the industry is firmly pointed in the direction of effective inventory management and cash flow optimization.

Flipping the traditional seed-to-sale mindset to a sale-to-seed strategy can help cannabis operators make smarter inventory decisions that protect margins and improve cash flow. By leveraging POS analytics, forecasting demand based on market trends and consumer behavior, evaluating make-or-buy decisions, and implementing JIT inventory practices, dispensaries and vertically integrated businesses can navigate the financial constraints and regulatory hurdles of the industry more effectively. This data-driven approach not only helps optimize inventory but also drives profitability and sustainable growth in the competitive cannabis market.

Cannabis Council of Canada Calls for Industry Reforms Following Election

Following Prime Minister Mark Carney’s election victory, the Cannabis Council of Canada called on the new government to “address glaring gaps and shortcomings in the legal cannabis industry.” 

In a statement, Paul McCarthy, president of the Cannabis Council of Canada, said, “With a new government in office, it’s time for action. The cannabis industry deserves the same attention and support as any sector of our economy.” 

“Canada likes to position itself as a global leader in legal cannabis – but since legalization in 2018, the federal government has failed this industry and the tens of thousands of hardworking Canadians it supports.” — McCarthy in a press release 

The council is calling for tax reforms, describing the current framework as “completely misaligned with today’s market realities,” noting that at the launch of the legal market in 2018, cannabis sold for $10 per gram, but today, producers are seeing about $3 per gram. Yet, the excise tax remains greater than 10% of the product’s value or $1 per gram. The council is calling on the new government to eliminate the $1 per gram floor and replace it with a 10% ad valorem rate – a fixed percentage based on the value of the goods, as determined by the invoice cost – which was proposed by the Standing Committee on Finance last year. 

The group is also urging lawmakers to “eradicate the criminal forces from the industry,” noting that illegal cannabis sales comprise between 25% and 40% of total cannabis sales in Canada and pointed to recent Government of Canada laboratory testing that found 94% of illegal cannabis products contained pesticides. The council suggests a strategy that includes shuttering unlicensed storefronts and online sales, intercepting shipments of illegal product, and launching a public awareness and education campaign on the dangers of supporting the unregulated market. 

The council is also calling for a national, single excise stamp for cannabis products, calling the current system, wherein each province and territory requires its own unique cannabis excise stamp, a “significant burden” on the industry.       

Since legalization, the cannabis industry has contributed over $43 billion to Canada’s gross domestic product, with approximately $7.4 billion contributed in 2024 alone, the group said. A recent survey found 57% of Canadians view cannabis as important to the country’s economy, and another 62% said it could play a more significant role in the future economy.
