Several new laws took effect in California at the start of the year, particularly regarding cannabis products. With Monday, April 20—recognized as cannabis holiday 4/20—approaching, residents may be curious about what is permissible in the state and what changes have occurred. While California residents aged 21 and over can legally use marijuana for recreational purposes, it remains illegal at the federal level. Additionally, the state continues to regulate the usage, possession, and sale of cannabis.
New Regulations for Cannabis Products for Animals
As of January 1, new regulations governing cannabis products designed for animals are now in place, according to the California Department of Cannabis Control. Prior to this, there were no clear standards statewide regarding cannabis for pets. With the passage of Assembly Bill 1885 in 2022, California established guidelines for what products can be produced and sold. Veterinary cannabis products must adhere to many of the same requirements as adult-use cannabis products but are subject to stricter restrictions. Only “edible cannabis products, orally consumed concentrates, and topical cannabis products” are permitted for animal use, and each product intended for pets cannot exceed 10 milligrams of THC per serving.
New Law for Hemp Extracts in Foods and Supplements
Assembly Bill 8, effective January 1, imposes stricter regulations on hemp-derived ingredients used in foods, beverages, and supplements in California. The law states that hemp extracts in these products must not contain THC or synthetic cannabinoids. Manufacturers are required to provide a certificate of analysis confirming that the product consists of 99% non-intoxicating compounds, such as CBD or CBN. While the law does not alter existing licensing requirements, businesses must still obtain authorization from the California Department of Public Health to produce hemp products. “AB 8 makes it clear that all intoxicating products must meet the same important standards expected by Californians,” said Nicole Elliott, Director of the California Department of Cannabis Control. These updated rules aim to enhance consumer safety.
