Minnesota Ends Criminal Penalties for Bong Water

A judiciary and public safety bill signed by Minnesota Gov. Tim Walz over the weekend included provisions ending criminal penalties for bong water, the Minnesota Reformer reports. Previously, quantities of bong water greater than four ounces could be treated like the pure version of whatever substance the bong was used to smoke – 4 ounces of bong water used to consume methamphetamine, for example, could lead to a first-degree felony charge carrying a 30-year prison term and $1 million fine.  

The language in the bill signed by Walz, removes that provision and specifies that for charging purposes, a drug mixture “does not include the fluid used in a water pipe or any amount of a controlled substance that is dissolved in the pipe’s fluid.” The change applies retroactively to August 2023 – a broader drug paraphernalia bill that took effect at that time. 

Alicia Granse of the American Civil Liberties Union, which is representing in court a women charged with a first-degree felony on account of water allegedly found in her bong, told the Reformer the organization “is glad to see the legislature fixed this loophole that allowed rogue prosecutors to put people suffering from addiction in prison for smoking drugs out of a bong.” 

The state Supreme Court ruled in 2009 that bong water could be legally considered a drug, relying on the testimony of a Minnesota State Patrol officer who claimed bong water could be kept “for future use… either drinking it or shooting it in the veins.”

Oregon regulators published fact sheets about the psilocybin services program.

Nebraska Lawmakers Again Reject Medical Cannabis Implementation Bill

The bill to set up Nebraska’s voter-approved medical cannabis program failed to advance in the legislature on Tuesday, failing a cloture vote 23-22, WOWT reports. It’s the latest setback for the program – approved by nearly three out of four Nebraska voters last November – although Gov. Jim Pillen (R) announced last week that his administration would provide support and resources for the Medical Cannabis Commission.   

Pillen also announced his picks for the commission: Dr. Monica Oldenburg, an anesthesiologist, and Lorelle Mueting, the prevention program director at Heartland Family Service. Those choices were denounced by Crista Eggers, executive director of Nebraskans for Medical Marijuana, which backed the referendum, as “fundamentally opposed” to medical cannabis 

“While we appreciate Governor Pillen‘s effort to take action in response to the will of the people, we find it disingenuous to characterize these appointments as ‘experienced and well-qualified.’ Both individuals have consistently express strong opposition to medical cannabis, both personally and professionally. Appointing regulators who are fundamentally opposed to the very issue they are charged with overseeing suggest that other motives maybe at play – motives that appear misaligned with the public intent, and not to mention the will of 71% of the state.” — Eggers, in a statement, via WOWT 

State Attorney General Mike Hilgers has called on lawmakers to reject the medical cannabis implementation bill, which he contends will “make Nebraska less safe, more dangerous.” 

The voter-approved law would give patients with any medical condition access to the program so long as they have a recommendation from a doctor or qualified medical practitioner.

Federal Judge Blocks Oregon Voter-Approved Measure Requiring Cannabis Labor Peace Agreements

A federal judge on Tuesday ruled that the voter-approved measure requiring Oregon cannabis businesses to set up labor agreements with their workers as a licensing condition violates the First Amendment right of business owners and is preempted by federal law. Measure 119 required cannabis retailers and processors “to agree to remain neutral when labor organizations communicate with employees about collective bargaining rights,” according to the measure text. 

The lawsuit was filed by Ascend, a Portland-based retailer, and Bubble’s Hash, an edibles and concentrates manufacturer. In the decision, U.S. District Judge Michael Simon said the measure “does not distinguish between permissible employer speech and threatening or coercive speech.” 

“Measure 119 seeks to regulate – and, indeed, forbid – certain truthful, non-deceptive, non-coercive speech about unionization, which conflicts with Congress’s intent to allow ‘uninhibited, robust, and wide-open debate in labor disputes.’” — Simon in the decision 

Simon added that state lawyers defending the measure “do not explain how an employer can remain ‘neutral’ with respect to union representatives communicating with its employees while still being free to express its opinions about unionization.”   

“Measure 119 is not limited to restricting only threatening, coercive, false, or misleading speech,” Simon wrote, “but instead prohibits all speech by employers that is not ‘neutral’ toward unionization.”   

Simon entered a permanent injunction, barring the enforcement of the measure.
