Majority Of Texas Voters Oppose Hemp Product Ban Like The One Vetoed By State’s Governor, Poll Finds

Republican voters were divided on the issue with 46 percent supporting a ban and 39 percent opposing it.

A majority of Texas voters oppose a comprehensive ban on hemp-derived THC products like the one recently vetoed by Gov. Greg Abbott (R), according to a statewide poll released this week.

The survey from the Texas Politics Project at the University of Texas at Austin found that 53 percent of Texas voters opposed the ban approved by the Legislature, Senate Bill 3, during the regular session that ended earlier this month. Thirty-one percent of voters voiced support for the ban.

Republican voters were divided on the issue with 46 percent supporting a ban and 39 percent opposing it, according to the poll that was conducted in early June after the Legislature adjourned but before the governor spiked SB 3 Sunday night.

Abbott’s veto of SB 3 drew immediate condemnation from Lt. Gov. Dan Patrick (R), the state’s second-in-command who had championed the ban. Patrick, the presiding officer of the state Senate, also rejected Abbott’s call for lawmakers to more strictly regulate the products—in lieu of a ban—during an overtime legislative session next month.

“The Legislature looks toward a potentially heated special session,” the pollsters wrote, noting voters’ divided views on the issue.

SB 3 would have banned consumable hemp products that contained tetrahydrocannabinol, the psychoactive compound in marijuana known as THC. Such products have become widely available at gas stations and smoke shops across the state since lawmakers authorized the sale of consumable hemp in 2019.

Since the last-minute veto, Patrick has blasted Abbott in a rare rift between the state’s top two elected officials, who have typically been friendly during the decade they have each served in their respective roles overseeing Texas’s rightward shift.

“This is a fight that didn’t need to be,” Patrick said Monday. “Where has he been all session? Where has he been? We get this [veto] proclamation from him last night after midnight, and he parachutes in at the last moment with arguments that we do not think are valid.”

On Tuesday, Patrick said, “it won’t be long before 8,000 smoke and vape shops will be out of business in Texas” after a federal appeals court let a similar ban resume in Arkansas.

Abbott had cited the Arkansas case in his veto proclamation, where he argued that SB 3 could not withstand legal scrutiny and would be tied up in the courts for years. Responding to the Tuesday ruling, Abbott said on social media that there were key differences between the Texas and Arkansas THC bans..

“Even though the Arkansas law was not plagued with the same legal defects as the Texas bill, it still was unenforced for two years and will be further tied up in court for years to come,” Abbott wrote. “I vetoed the Texas bill because we do not have time for a protracted legal fight — we must act now to keep Texas children safe. That process begins next month.”

The governor has not otherwise responded to Patrick’s criticism and accusations.

The divided views among Republican voters on the THC ban reflect their changing attitudes on the legal status of marijuana, according to Texas Politics Project polling.

A decade ago, 31 percent of Texas Republicans said marijuana possession should not be legal under any circumstances. That figure now stands at 21 percent. Meanwhile, the percentage of Republican voters who backed legalization of small amounts of marijuana for any purpose increased from 23 percent in 2015 to 31 percent in April.

Jones Soda Co. Sells Mary Jones THC Beverage Brand

Seattle-based Jones Soda Co. has sold its hemp-based THC beverages brand Mary Jones to MJ Reg Disrupters for $3 million to “streamline operations and focus on its core soda offerings,” according to a press release.

Jones Soda unveiled its cannabis segment in 2022, launching Mary Jones first in California and then expanding the brand to other states. The company’s infused beverages contain hemp-derived delta-9 THC and cannabidiol (CBD).

MJ Reg Disrupters purchased Mary Jones with an initial June 19 cash payment of $489,399 plus an additional $2,510,610 via promissory notes over the next three years.

Jones Soda CEO Scott Harvey called the sale “an important milestone in our effort to focus our resources on areas where we see the strongest long-term growth and profitability.”

“We are proud of the innovation behind the Mary Jones brand, but I believe this divestiture enables us to sharpen our strategic priorities and accelerate investment in our core soda, functional beverage, and adult beverage categories.” — Harvey, in a statement

Chicago Police Can’t Search Vehicles Based on Smell of Raw Cannabis Under New Rules

Chicago Police Department (CDP) officers will not be allowed to search vehicles based only on the smell of raw cannabis under a rule change approved by officials on Monday, WTTW reports.

Advocates had pursued the change under a 2019 federal court order requiring the department to reform its policies, and CPD officials agreed to the rule change despite initial objections. The American Civil Liberties Union of Illinois said in a Monday court filing that it “applauds” the department’s decision last month to adopt the policy change.

The change comes despite the Illinois Supreme Court ruling in 2024 that the smell of raw cannabis is sufficient grounds for police to conduct a vehicle search during a traffic stop. Three months earlier, however, the same court ruled that the smell of burnt cannabis is not sufficient grounds for searching a vehicle without a warrant. 

CPD reported conducting just 70 traffic stops based on suspected cannabis violations from December 2024 to June 2025 — the department, however, does not track how many traffic stops occur based on the smell of raw cannabis, according to the report.

Adult-use cannabis is legal in Illinois; however, state law requires cannabis to be stored in a “sealed, odor-proof, child-resistant cannabis container” when being transported in a vehicle.

Tilray Brands Subsidiary is First Company in Italy Approved to Distribute Medical Cannabis Flower

FL Group, a wholly owned subsidiary of Tilray Brands Inc., has become the first company in Italy to receive government approval to distribute medical cannabis flower. The products are set to be available this month in pharmacies throughout the country.  

In a statement, Denise Faltischek, chief strategy officer and head of International at Tilray Brands, said the “milestone underscores the vital role of medical cannabis as a therapeutic medicine for patients in need, supporting their health and well-being.” 

“We are proud to expand our medical cannabis portfolio in Italy with the introduction of our Tilray Medical high-quality, EU-GMP certified medical cannabis products that uphold the highest standards in patient care,” Faltischek said. “We extend our gratitude to the Ministero della Salute (Italian Ministry of Health) for their trust in Tilray Medical and for providing the necessary regulatory framework to ensure access to safe, consistent and reliable cannabinoid-based therapies. Together, we are advancing health care and patient wellness through innovation and collaboration.” — Faltischek in a press release 

The three approved products include Tilray Medical’s Tilray THC 25%, Tilray THC 18%, and Tilray THC 9%/CBD 9%. 

Italy legalized medical cannabis in 2013 and initially relied on imported medical cannabis products; however, the Italian Army was later tasked with local cultivation at the Military Pharmaceutical Plant in Florence, which was criticized for producing low quality flower.
