Idaho Lawmakers Endorse Resolution Urging Voters to Reject Medical Cannabis Initiative

The Idaho House of Representatives has joined the Senate in passing a resolution that urges voters to “reject” an initiative to legalize medical marijuana on the November ballot. The resolution, sponsored by the Senate State Affairs Committee, asserts that cannabis legalization in other states has resulted in increased cartel activities, black market marijuana production, human trafficking, heightened crime rates, serious health issues, environmental harm, and safety concerns in workplaces.

Having cleared the Senate via a voice vote, SCR 127 gained approval in the House with a 58-9 vote. The measure argues that the marijuana initiative would not only increase costs for the state but that its criteria for approved medical conditions is overly broad, allowing nearly anyone to qualify. The resolution states, “The Idaho Medical Cannabis Act lacks safeguards to such an extent that it would effectively legalize widespread recreational use of marijuana,” emphasizing potential detrimental impacts on Idaho families and children. The Legislature urges citizens to reject any moves to bring the act to the ballot.

A purpose statement accompanying the legislation highlights the “devastating impact” that marijuana legalization has had in other states and specifies various concerns about the ballot initiative. In contrast, the Natural Medicine Alliance of Idaho (NMAI), the organization advocating for the legalization measure, contests the resolution’s claims. “Idahoans deserve to vote on this issue, and we are confident we will be able to get it in front of them this November,” stated Amanda Watson, a spokesperson for NMAI.

The NMAI argues that thousands of Idahoans suffering from various conditions require alternatives to opioids. Watson stressed the group’s commitment to outreach and signature collection across the state to ensure support for the initiative. Advocates of cannabis reform often cite data suggesting that legalization reduces illegal market sizes and does not lead to increased youth cannabis use.

Concerns were expressed during a House State Affairs Committee hearing, with Rep. Stephanie Mickelsen (R) citing her experiences in regions that have legalized marijuana, claiming increased homelessness and substance issues. Rep. Jaron Crane (R) compared attitudes in areas with legalized marijuana to conditions in Idaho’s largest cities.

The NMAI has projected that medical marijuana could generate over $100 million in sales annually for Idaho, along with up to $28 million in state revenue if voters approve the initiative. They recently reported surpassing the required statewide threshold for ballot signatures and are continuing efforts to meet additional criteria for regional distribution. As of Monday, over 77,000 signatures had been collected, exceeding the necessary total.

Key Provisions of the Idaho Medical Cannabis Act

The Idaho Medical Cannabis Act, unveiled by NMAI last October, aims to provide medical marijuana access for patients with qualifying conditions through licensed dispensaries. Key provisions include:

  • Health practitioners may recommend medical cannabis for conditions such as cancer, anxiety, and acute pain.
  • Patients or caregivers can purchase up to 113 grams of smokeable cannabis or 20 grams of THC extract per month.
  • The state will initially issue three cannabis business licenses, with a potential total of six thereafter.
  • Marijuana would be reclassified under state law as a Schedule II controlled substance.
  • State law enforcement would be prohibited from assisting federal drug enforcement activities involving the state-legal cannabis program.
  • Anti-discrimination protections would be established for compliant cannabis users and sellers.

Despite not including equity-centered reforms or a home grow option, NMAI asserts that access to legal, compassionate care is essential for Idahoans. Their mission emphasizes creating a regulated medical program that supports local agriculture and tax revenue.

A recent statewide poll indicated strong support for medical cannabis legalization, with 83 percent of likely voters in favor. Following the introduction of the medical cannabis initiative, another campaign, Kind Idaho, suspended its signature gathering for a separate initiative to legalize personal marijuana possession and cultivation. Moreover, a proposed constitutional amendment is set to appear on the ballot, aiming to restrict the legalization of controlled substances to legislative action.

As the Idaho legislature continues its discussions, past proposals, such as mandatory minimum fines for cannabis possession, have stalled without significant movement. The evolving cannabis landscape in Idaho reflects broader tensions in state and national policy dialogues.
