GOP’s Efforts Against Marijuana Legalization Highlight Broader Struggle for Democracy in Ballot Initiatives

Ken Newburger felt blindsided by the Mississippi Supreme Court’s ruling that overturned Initiative 65, a medical cannabis ballot measure approved by 74 percent of voters last fall. Despite knowing about the legal challenge against the initiative, he was confident that the court would uphold it, given the overwhelming public support. “It was not how I felt the decision would go,” Newburger reflected on the ruling made on May 14th. “I thought the court would not throw out an election.”

Newburger served as the director of field outreach for Initiative 65, which aimed to legalize medical cannabis for various conditions. However, the Republican mayor of Madison, Mary Hawkins Butler, filed a lawsuit asserting that the measure was illegal due to a requirement that ballot initiatives collect signatures from five congressional districts—despite Mississippi only having four since the 2000 Census. This outdated stipulation was not properly addressed, leading to the court’s decision that the initiative process “no longer functions.”

Impact on Cannabis Legislation

The court’s ruling is part of a broader trend across the country, where Republican lawmakers are working to undermine the ballot initiative process, particularly concerning cannabis legalization. Many conservatives support the legalization of cannabis among voters but resist it within legislative frameworks. The Mississippi Supreme Court’s decision resonates with similar situations in states like South Dakota, where the initiative aimed at legalizing cannabis is also under legal scrutiny.

South Dakota’s Governor Kristi Noem is attempting to delay the implementation of approved medical cannabis measures, leveraging tax dollars for efforts to overturn voter-approved initiatives. The legal arguments against these initiatives often pivot on technicalities, such as claims that constitutional amendments must focus solely on single subjects—despite evidence to the contrary.

Challenges to Voter Initiatives

Efforts to stymie the ballot initiative process are not unique to cannabis. In Idaho, recent legislative changes have made it more difficult for organizers to qualify initiatives for the ballot, particularly ones advocating for medical cannabis. The new requirement for collecting signatures from a larger number of districts complicates the process, leaving many advocates concerned that only well-funded interests will succeed.

Matthew Schweich, deputy director of the Marijuana Policy Project, voiced that this intensified push against ballot initiatives aligns with broader anti-democratic practices such as gerrymandering and voter suppression. He articulated that the assault on ballot initiatives responds to various progressive issues legislators aim to quell.

Future of Cannabis in Mississippi

Despite the setback, Newburger remains optimistic about reintroducing medical cannabis legislation, given that a significant portion of the Mississippi populace desires such a program. Following the court’s ruling, he noted the potential for lawmakers to convene a special session to legislate the issue. “The way that the initiative process was rendered unworkable means we can’t sit around and wait for it to be fixed,” Newburger stated. “Most of the people I’ve talked to are now looking toward the Capitol for action.”

This moment serves as a crucial juncture for Mississippi’s cannabis industry. With continued momentum for legalization from the electorate, the landscape may shift as legislators respond to public demand. Newburger and others are prepared to act as they await further developments on legislative changes that could pave the way for a functioning medical cannabis program in Mississippi.
