Gov. Tate Reeves Signs Landmark Bill into Law to Enhance Education Funding in Mississippi

On February 2, 2022, Mississippi became the 37th state to legalize medical marijuana after Governor Tate Reeves signed the bill into law. This development follows significant debate and revisions to the proposed legislation.

Governor Reeves, who had previously remained noncommittal regarding his stance on the bill, announced his decision via social media. He expressed gratitude to the legislators for their efforts, stating, “I am most grateful to all of you: Mississippians who made your voice heard.”

Details of the Medical Marijuana Program

The program will be overseen by the Mississippi State Department of Health and is set to commence within 120 days, during which the first licenses for cannabis growing, cultivation, and packaging facilities will be issued. Dispensaries are expected to be licensed within 150 days of the bill’s enactment.

Senator Kevin Blackwell and Representative Lee Yancey played pivotal roles in shaping the legislation, making numerous adjustments per the Governor’s directives. Notably, the law permits medical marijuana patients to purchase up to 3 ounces per month, a reduction from the 5 ounces originally favored by voters. The Senate initially passed a 3.5-ounce provision, but the House amended it to 3 ounces for a more conservative approach.

Legislative Context and Concerns

The limitation on cannabis amounts has been a contentious issue for Governor Reeves, who expressed concerns that higher allowances could lead to increased recreational use. “There are also those who really want a recreational marijuana program that could lead to more people smoking and less people working,” he remarked, highlighting potential societal impacts.

A majority of Mississippians endorsed the creation of a medical marijuana program during the November 2020 election, underscoring local support for this initiative. Ultimately, the passage of the bill in both legislative chambers rendered Governor Reeves’ approval largely symbolic, as there were sufficient votes to override a potential veto.

This legislation marks a significant shift in Mississippi’s cannabis policy landscape, opening avenues for business and regulatory developments in the state’s burgeoning medical marijuana industry.
