For instance, California’s tax briefly rose from 15% to 19% before being retracted to provide relief to the struggling industry. Similarly, Michigan’s new wholesale tax emerged to address transportation revenue needs.

Excise taxes on recreational marijuana are often not ideal for addressing general revenue shortfalls or funding unrelated programs. Excessive taxation can stifle growth in the legal cannabis market, pushing consumers back to illicit sources. States that enforce high taxes or impose stringent licensing requirements may not see meaningful reductions in illegal consumption. To encourage consumers to transition to safer, legal products, it is crucial that prices in legal markets remain competitive with those of illicit markets.

If interstate commerce is eventually permitted, the differences in state tax structures could lead to complications such as tax avoidance or market inequities. States should proactively work on harmonizing their tax policies now to prepare for a future in which interstate cannabis business is viable.
